FBI, U.S. Attorney’s Office Prepare for Potential Violence, Ask Public to Send Information

The Albuquerque FBI Division and the U.S. Attorney’s Office are working with federal, state, and local partners to prepare for any potential violence in New Mexico related to the recent unrest in Washington, D.C., and the upcoming presidential inauguration.

The FBI has set up a command post to monitor any emerging threats in our region and share intelligence with our partners.

FBI assets are on standby to support investigations and respond to any potential threats of violence to the state capitol, federal buildings, and other key facilities.

“Our focus is not on peaceful protesters, but on those individuals who may want to incite violence and engage in criminal activity,” said FBI Special Agent in Charge James Langenberg. “The public can help by contacting us if they are aware of anyone planning to commit acts of violence or damage to government buildings.”

“While we will protect and defend the peaceful exercise of free speech, we will not tolerate violence, wanton disregard for the law, or incitement to criminal activity. The U.S. Attorney’s Office in New Mexico is working closely with the FBI and our other federal law enforcement partners and we are prepared to act if there is a nexus to our jurisdiction that warrants federal charges,” Acting U.S. Attorney Fred Federici said.

The FBI also continues to seek information that will assist in identifying individuals who engaged in violence at the U.S. Capitol building and surrounding area on January 6.

FBI Looks for Teen Who Allegedly Absconded from Pre-Trial Release in Albuquerque

A man charged federally with being a felon in possession of ammunition is being sought for allegedly absconding from pre-trial release in Albuquerque.

Adrian Nieto, Jr., 19, of Albuquerque, is accused of leaving an Albuquerque halfway house without permission on December 24, 2020, a day after he was placed on pre-trial conditions of release.

The FBI had arrested Nieto on December 17, 2020.

A federal warrant has been issued for Nieto’s arrest.

Anyone with information on the whereabouts of Nieto is asked to contact the FBI at (505) 889-1300 or online at tips.fbi.gov.

The Albuquerque Police Department is assisting with the investigation.

Iowa Man Arrested for Actions at the U.S. Capitol

On Monday, January 18, 2021, Leo Christopher Kelly was arrested on a federal warrant by special agents from the FBI Omaha Field Office’s Cedar Rapids Resident Agency. The federal charges include Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority, and Violent Entry with Intent to Disrupt the Orderly Conduct of Official Business and Disorderly Conduct on Capitol Grounds. The charges stem from the events at the Capitol Building on January 6, 2021.

Kelly remains in federal custody. He will have his initial appearance in federal court on Tuesday, January 19, 2021. After Kelly’s appearance you will find any additional information at this link—Investigations Regarding Violence at the Capitol (justice.gov).

FBI Omaha Stands Up Command Post

To ensure the safety of our communities, the FBI Omaha Field Office has established a command post to gather intelligence and coordinate with our local and state partners on potential threats. At this point in time, the FBI has not received any specific and substantial threat to the state Capitols or other government buildings in our area. However, we are working together with our law enforcement partners to continuously share information based on tips submitted by the public.

FBI Omaha is focused on identifying, investigating, and disrupting individuals who continue to incite violence and engage in criminal activity here locally. Special Agent in Charge Eugene Kowel says, “Between now and the presidential inauguration on January 20, we will maintain a heightened posture to monitor for any emerging threats to our region.”

Agent-Involved Shooting

The FBI is reviewing an agent-involved shooting which occurred today when special agents executed a federal search warrant at a residence in Florissant. No one was injured, and a male subject was arrested.

The FBI takes all shooting incidents involving our agents seriously. In accordance with FBI policy, the shooting incident is under investigation by the FBI’s Inspection Division. The review process is thorough, objective, and conducted as expeditiously as possible under the circumstances. As this remains an on-going matter, the FBI has no further comment.
