Thank you, President Biden. Thank you, Vice President Harris, for bringing us together today. Thank you, Jen. And thank you, Secretary Becerra, for highlighting the urgency of this crisis, and for your partnership.

In the five weeks since the Supreme Court overturned Roe and Casey, legislatures across the country have taken steps to impose bans and other restrictions on access to abortion, with devastating consequences for women’s health, their safety, and their civil rights.

And we know that the harms caused by these laws have been and will continue to be especially severe for people of color and for those of limited means.

Since the day that Dobbs was decided, the Justice Department has made clear that we will be relentless in our efforts to protect and advance reproductive freedom.

As we have said repeatedly, women who reside in states that have banned access to abortion must remain free to seek that care in states where it is legal.

Under fundamental First Amendment principles, people must also remain free to inform and counsel each other about the reproductive care that is available in other states.

States may not ban the abortion medication Mifepristone on disagreement with the FDA’s expert judgment about its efficacy and safety.

And federal agencies may continue to provide reproductive health services to the extent authorized by federal law.

Last week, I also said that the Department is vigilantly monitoring state laws and enforcement actions to ensure that states do not infringe on federal protections of reproductive rights.

And I said that when they do, we will consider every tool at our disposal, including filing affirmative cases, statements of interest, and intervening in private litigation.

Yesterday, the Justice Department filed a lawsuit against the State of Idaho to hold invalid that State’s criminal prohibition on providing abortions, as applied to women who are suffering medical emergencies.

As we explained in our complaint, Idaho’s near-total ban on abortion directly conflicts with the Emergency Medical Treatment and Labor Act, or EMTALA. That federal law requires hospitals receiving Medicare funds to provide necessary stabilizing treatment to people suffering from an emergency medical condition.

As I said when we announced this suit, it does not matter what state a hospital subject to EMTALA is located in.

If a patient comes into an emergency room with a medical emergency jeopardizing the patient’s life or health, the hospital must provide the treatment necessary to stabilize that condition.

And this includes abortion when that is the necessary treatment.

Any state law that prevents a hospital from fulfilling its obligations under EMTALA violates federal law.

The Justice Department will also be filing a motion to dismiss the Texas lawsuit challenging HHS’s guidance under EMTALA. The law could not be clearer, and we are going to vigorously litigate this suit to ensure women get the emergency care to which they are entitled under federal law.

Led by Associate Attorney General Vanita Gupta, the Department’s Reproductive Rights Task Force will continue to build on these efforts to protect reproductive freedom.

Its work includes monitoring state laws that infringe on federal constitutional protections, evaluating appropriate actions in response to those laws—including filing lawsuits and statements of interest—and coordinating technical assistance to both Congress and the States on federal constitutional and statutory considerations.

Five weeks ago, I promised that the Justice Department would work tirelessly to protect reproductive freedom, and that we would not waver from our founding responsibility to protect the civil rights of all Americans.

That is what we have done, and that is what we will continue to do.

Security News: Man and Woman Convicted in Connection with False Statement to a Federal Officer

Gulfport, Miss.  – Two individuals were convicted in connection with making a false statement to a federal officer, announced U.S. Attorney Darren J. LaMarca and Special Agent-in-Charge Jermicha L. Fomby of the Federal Bureau of Investigation, Jackson Field Office. 

Stevie Allen Stoudenmier, Jr., 37, of Hattiesburg, pled guilty to the federal felony of unauthorized possession of an identity document with intent to defraud the United States. Kimberly Ann Hinton, 31, also of Hattiesburg, was sentenced for the related offense of misprision of felony in connection with a material misrepresentation to a National Park Service Law Enforcement Ranger.

According to court documents, on February 4, 2021, a National Park Service Ranger conducted a traffic stop of Stoudenmier in the Gulf Islands National Seashore, Davis Bayou location in Jackson County.  Stoudenmier was driving a vehicle registered to Hinton with Hinton as the front seat passenger.  When Stoudenmier identified himself to the Law Enforcement Ranger, Stoudenmier gave the Ranger the name, Social Security Number, date of birth and other stolen identity information of a man from Picayune, Mississippi.  Hinton then produced the Identification Card of the victim. 

Stoudenmier was issued misdemeanor citations in the name of the victim from Picayune.  Later, the victim contacted the Government after receiving the summons for the citations and notice to appear in federal court in Gulfport.  The Federal Bureau of Investigation and the National Park Service investigated the complaint and Defendant Stoudenmier was identified using official law enforcement “body-cam” video of the traffic stop and “body-cam” video regarding a separate incident with Stoudenmier and Hinton using the same ID card with the Biloxi Police Department. 

Hinton, who previously pled guilty, was sentenced to “time served” (effectively five months and one day), as well as to pay a $1,500 fine and to serve one year of supervised release. 

Stoudenmier is scheduled to be sentenced on November 15, 2022, and faces a maximum sentence of 5 years in federal prison, followed by 3 years of supervised release, and a $250,000 fine.  A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

The case was investigated by the FBI, the National Park Service, and the Biloxi Police Department. 

Assistant U.S. Attorney Stan Harris is the prosecutor for the case.

Security News: Shreveport Man Sentenced on Federal Charge of Second Degree Murder of U.S. Postal Service Employee

SHREVEPORT, La. – United States Attorney Brandon B. Brown announced that Michael Jarred Gentry, 33, of Shreveport, Louisiana, was sentenced today by Chief United States District Judge S. Maurice Hicks, Jr. on a charge of second degree murder. Gentry was sentenced to 480 months (40 years) in prison, followed by 5 years of supervised release.

On June 22, 2019, Antonio Williams, a U.S. Postal Service Letter Carrier, was delivering mail in Shreveport. Shortly after 11:00 a.m., Williams was carrying mail to an apartment on Dudley Drive. Inside that apartment was Gentry, armed with a semi-automatic rifle. As Williams approached the apartment, Gentry fired four shots through the front door, striking Williams twice. Mr. Williams was pronounced dead at a nearby hospital shortly thereafter.

Gentry entered his guilty plea to the charge of second degree murder on March 21, 2022 and the United States and Gentry agreed to the stipulated sentence of 40 years in prison.

“This is a difficult day for the family and friends of Antonio Williams,” stated U.S. Attorney Brandon B. Brown. “This family has suffered the tragic loss of a father and husband who cannot be replaced.  Although we know that this sentence will not fill the void that these family members and friends have suffered, we hope that it brings them some comfort knowing that this defendant will serve such a lengthy sentence in federal prison where there is no parole. I would like to thank the U.S. Postal Inspection Service for their efforts in assisting with this investigation, as well as the Shreveport Police Department and federal agents with the ATF. It was because of their quick response and thorough investigation that we were able to bring this defendant to justice.”

“The sentencing of Michael Gentry for the murder of postal employee Antonio Williams brings to an end the investigation of a heinous crime,” said Scott Fix, Inspector in Charge of the Houston Division of the USPIS.  “The safety and well-being of Postal Service employees is a top priority for the Postal Inspection Service, and every act of violence elicits an immediate and firm response.  Postal Inspectors worked tirelessly with our law enforcement partners to seek justice for the victim and his family.” 

This case was investigated by the U.S. Postal Inspection Service, Shreveport Police Department, and Bureau of Alcohol, Tobacco, Firearms and Explosives, and was prosecuted by U.S. Attorney Brandon B. Brown and Assistant U.S. Attorney Mike Shannon.

TMF Invests in Improving Public-Facing Services, Bolstering Cybersecurity

Investments in DOL, AmeriCorps and USAID expand zero trust cybersecurity cohort and deliver digital-first customer experience

WASHINGTON – Today, the Technology Modernization Fund (TMF) announced investments that will modernize services, improve customer experience, and strengthen cybersecurity. An investment in the Department of Labor (DOL) will help to modernize how employers access permanent labor certification services, and will create a more seamless visa processing experience. With TMF support, AmeriCorps will replace a 20-year-old system with a new integrated system that allows the agency and its partners to better focus on serving local communities. And an investment in the U.S. Agency for International Development (USAID) will reduce the cyber risks associated with the agency’s global mission, and will improve user experience for its workforce.

The latest tranche of TMF investments – the first since the $100M designation to improve public-facing digital services – advances the federal IT operating plan’s digital-first customer experience and cybersecurity goals, while continuing to support the American Rescue Plan’s intent and investment priorities. These investments add to the TMF’s rich experiential data set of agencies tackling similar modernization issues, and expands the cohort of agencies addressing those issues together.

“The TMF provides critical funding to address urgent IT modernization and cybersecurity challenges across the federal government,” said TMF Board Chair and Federal CIO Clare Martorana. “The investments in DOL, AmeriCorps, and USAID will modernize outdated systems, accelerate implementation of zero trust architecture to address immediate cybersecurity gaps, and enhance public-facing services in order to provide simple, seamless, and secure access to government services.”

“The TMF continues to make smart technology investments to modernize IT systems, safeguard sensitive data, and provide the American taxpayers with efficient, effective access to necessary services,” said TMF Executive Director Raylene Yung . “These investments demonstrate the federal government’s commitment to transforming the way agencies use technology while improving the end-user experience.”

How these investments will modernize services and secure assets:

New Community Grant Management System at AmeriCorps

More than 2,800 nonprofit, faith, and community-based organizations that provide invaluable services in more than 40,000 community locations rely on AmeriCorps’ grant system to manage their federal grant awards. The current system, developed in 2002, is no longer fit for its purpose and restricts AmeriCorps’ ability to meet its mission, keep pace with the current grant-making standards and technical needs, and appropriately steward agency resources. With a TMF investment of $14 million, AmeriCorps will replace its antiquated system with a modern platform that allows the agency and its partners to better focus their efforts on improving the communities they serve.

“AmeriCorps is grateful to receive funding from TMF to modernize our information technology infrastructure,” said AmeriCorps CEO Michael D. Smith. “This funding directly impacts our ability to meet our mission by upgrading our grants management system and improving outreach to organizations and volunteers at the local level.”

Integrated Visa Processing at the Labor Department

The $7.2 million TMF investment will improve DOL’s permanent labor certification services, helping to increase efficiency, improve customer experience, and address fraud and security risks overall.

“Our nation can be stronger and more prosperous when our immigration system functions in the most fair, orderly, and efficient manner, and this investment of TMF funding will help us deliver on that commitment,” said Brian Pasternak, Administrator, Office of Foreign Labor Certification. “By integrating the permanent labor certification process into the Foreign Labor Application Gateway, which uses GSA’s Login.gov, we will make it easier, faster, and cheaper for employers to access permanent labor certification services and create a more seamless immigrant visa processing experience.”

“The Department has developed a close working relationship with the TMF with past TMF awards and appreciates the opportunity to build technologies that ease the burden on U.S. employers,” added Department of Labor Chief Information Officer Gundeep Ahluwalia.

Boosted Security for USAID’s Global Assets and Workforce

A TMF investment of $5.6 million will extend and enhance security controls throughout USAID’s distributed network,providing a greater degree of protection for the agency’s cyber assets, and improving the work experience of 13,000+ end users around the world. This will be accomplished by consolidating identities, modernizing authentication, providing password-less technology, and expanding the agency’s secure work for “anytime, anywhere” access. Advancing the development timeline, USAID anticipates over 50% of its users will be transitioned to a new identity management system by FY 2024.

“TMF funding will allow USAID to accelerate its zero trust initiative across an ‘anytime-anywhere’ organization of over 13,000 end users worldwide, improve customer experience, and reduce mission risks as it helps execute the Administration’s foreign assistance and development priorities,” said Paloma Adams-Allen, Deputy Administrator for Management and Resources.

All agencies plan to repay the TMF in alignment with repayment guidelines by the end of FY 2028. These latest actions bring the total of TMF investments to 29 ongoing projects, with well over half a billion dollars now invested.

GSA announces $117 million contract to improve efficiency at 12 Georgia federal buildings

ATLANTA, GA – Today, U.S. General Services (GSA) Administrator Robin Carnahan joined White House Council on Environmental Quality (CEQ) Chair Brenda Mallory and Congresswoman Nikema Williams (GA-05) at the Sam Nunn Federal Center to announce new energy and water efficiency investments, and promote the Biden-Harris Administration’s efforts to make the federal footprint more sustainable and cost-efficient. Administrator Carnahan announced the award of a $117 million Utility Energy Service Contract (UESC) that will provide efficiency improvements in 12 Georgia federal buildings.

Chair Mallory also announced the launch of the Biden-Harris Administration’s Climate Smart Buildings Initiative, which will leverage public-private partnerships to modernize federal buildings to better meet agencies’ missions, create good-paying jobs, and cut greenhouse gas (GHG) emissions. By setting and meeting emissions reduction targets for federal buildings, the Climate Smart Buildings Initiative is expected to catalyze over $8 billion of private sector investment by 2030 to modernize facilities through energy savings performance contracts. The initiative is expected to create and support nearly 80,000 good-paying American jobs and achieve up to 2.8 million metric tons of GHG reductions annually by 2030.

“The investments we’re making here in Georgia demonstrate how investing in sustainability is a triple win – creating good-paying clean-energy jobs, reducing energy costs, and tackling climate change to ensure a healthier future for the next generation,” said Administrator Carnahan. “The federal government wants to lead by example by leveraging our scale and buying power to help drive these efforts.”

“President Biden has made clear, climate change is a crisis, and it won’t go away without ambitious, decisive action,” said White House CEQ Chair Mallory. “Through the Biden-Harris Administration’s Climate Smart Buildings Initiative, we will replicate work Administrator Carnahan is leading at GSA to cut Federal building energy costs and emissions in Georgia and across the country. This means creating good jobs, saving taxpayer dollars, and accelerating our Made in America clean energy economy.”

The UESC award to Southern Company will provide energy and water efficiency improvements in 12 Georgia federal buildings through infrastructure improvements in chillers, boilers, air handler units, digital building controls, lighting, electrical transformers, low flow and flush water fixtures, spring water capture, and renewables technologies. The improvements will include the first wind-powered renewable energy system installed in a GSA federal building. UESCs are contracts between a federal agency and utilities for energy management services, including energy and water efficiency improvements and energy demand reduction.

The event showcased the Biden-Harris Administration’s leadership in decarbonizing the federal footprint and making federal buildings more efficient, while saving taxpayer dollars, creating clean energy jobs, and strengthening American leadership and competitiveness. The Administration has set the ambitious goal of sourcing 100 percent carbon pollution-free electricity (CFE) on a net annual basis by 2030, including 50 percent 24/7 carbon pollution-free electricity.

In addition, Administrator Carnahan and Chair Mallory detailed the importance of the historic Inflation Reduction Act currently under debate in the Senate, which would make the single largest climate investment in U.S. history, as well as President Biden’s Fiscal Year 2023 Budget Proposal, which includes a $72 million investment for critical system and infrastructure improvements at the Sam Nunn Federal Center.

GSA recently announced that it had achieved a 51% reduction in greenhouse gas emissions from GSA-owned buildings. The reduction of more than a million metric tons annually represents the equivalent of taking 223,000 cars off the road every year. GSA has also avoided over $638 million dollars in energy costs since 2008 through energy efficiency improvements and other upgrades.
