Security News: Jury Convicts Former Oregon Securities Broker of Tax Evasion

PORTLAND, Ore.—After a two-week trial, a federal jury in Portland found a McMinnville, Oregon man guilty today of evading $2.5 million in income taxes by hiding his income in multiple bank accounts and submitting false financial statements to the IRS.

James Millegan, 65, was convicted of one count of tax evasion.

According to court documents, Millegan owned and operated J.W. Millegan, Inc., a small, commission-based investment advisory business that served clients in the Portland and Salem, Oregon metropolitan areas. From 1996 to 2016, the investment firm was Millegan’s only significant source of income.

Over a seven-year period from July 2009 through September 2016, Millegan evaded payment of $2.5 million in income taxes. Millegan filed tax returns each year reflecting his true income, which sometimes exceeded $1 million, and the taxes he owed on that income, which typically ranged from $125,000 to $350,000. Despite these returns, Millegan often failed paid the IRS. 

Millegan was described as a prolific spender by personal assistants hired to pay his bills. He used the proceeds of his tax evasion to fund an extravagant lifestyle that included a $4.5 million home in Portland, a $1.3 million home on the Oregon coast, Rolls Royce and Bentley automobiles for everyday use, equestrian expenses like stabling and lessons, and an attempt to establish a world-class equestrian competition center and resort near Sheridan, Oregon. Millegan also bought a classic 1938 Rolls Royce touring car, spent $800,000 restoring it, and showed it in premier car shows in the U.S., Great Britain, and Europe.

To evade the payment of his income taxes, Millegan concealed his income from the IRS by transferring it to six bank accounts he controlled, including transferring $1.4 million to the bank account of his deceased mother’s trust, which he used to pay his personal expenses. From July 2009 through September 2016, Millegan transferred $3.7 million to these accounts. To further conceal his income, Millegan submitted false financial statements to the IRS.

On November 21, 2019, a federal grand jury in Portland returned a 13-count indictment charging Millegan with tax evasion and investment churning. Later, on February 17, 2022, he was charged by superseding indictment with wire fraud and tax evasion. A jury trial on the wire fraud charges is scheduled to begin in March 2023.

Tax evasion is punishable by up to five years in federal prison. Millegan will be sentenced on April 3, 2023, by U.S. District Court Judge Karin J. Immergut.

This tax evasion case was investigated by IRS-Criminal Investigation. Seth D. Uram and Meredith D.M. Bateman, Assistant U.S. Attorneys for the District of Oregon, are prosecuting the case. Assistant U.S. Attorney Hannah Horsley assisted the trial team.

Defense News: USS Delbert D. Black (DDG 119) Flies Enlisted Surface Warfare Specialist Pennant

Cryptologic Technician 2nd Class Rex Wright, the most recently qualified ESWS Sailor aboard Delbert D. Black, raised the ESWS pennant alongside the ship’s command master chief, Christopher Bartley.

“Being the one to raise the pennant was monumental for myself and the ship,” said Wright. “It was a culmination of all the hard work. I feel truly blessed.”

To earn an ESWS pin, Sailors are required to complete standardized common core and platform-specific qualification books, training sessions with subject matter experts, and written and oral exams to demonstrate their knowledge of surface warfare.

“The Sailors earning their warfare pin put in the effort to qualify over a dozen prerequisites and two ESWS qualification books,” said Bartley. “Our first class petty officers led the way with countless training sessions and mess deck rodeos, and our chief petty officers finalized with multiple walkthroughs and the final oral boards. It is a milestone in every Sailors career to qualify as an enlisted surface warfare specialist, but to do it on a ship named for an enlisted Sailor and that of our first master chief petty officer of the Navy makes them true trailblazers in their own right. Having a junior enlisted Sailor raise the pennant brought all that hard work together.”

The Nimitz-class aircraft carrier USS George H.W. Bush (CVN 77) is the flagship of Carrier Strike Group (CSG) 10 and the George H.W. Bush CSG. CSG-10 is comprised of George H.W. Bush, Carrier Air Wing (CVW) 7, Destroyer Squadron (DESRON) 26, the Information Warfare Commander, and the Ticonderoga-class guided-missile cruiser USS Leyte Gulf (CG 55).

The ships of DESRON 26 within CSG-10 are USS Nitze (DDG 94), USS Farragut (DDG 99), USS Truxtun (DDG 103), and Delbert D. Black.

The squadrons of CVW-7 embarked aboard George H.W. Bush are the “Sidewinders” of Strike Fighter Squadron (VFA) 86, the “Jolly Rogers” of VFA-103, “Nighthawks” of VFA-136, the “Pukin Dogs” of VFA-143, the “Bluetails” of Carrier Airborne Early Warning Squadron (VAW) 121, the “Patriots” of Electronic Attack Squadron (VAQ) 140, the “Nightdippers” of Helicopter Sea Combat Squadron (HSC) 5, and the “Grandmasters” of Helicopter Maritime Strike Squadron (HSM) 46.

The George H.W. Bush CSG is on a scheduled deployment in the U.S. Naval Forces Europe-Africa area of operations, employed by U.S. Sixth Fleet to defend U.S., allied, and partner interests.

Defense News: USS Normandy (CG 60) Visits Namesake Region

During the visit, USS Normandy will participate in a wreath laying ceremony at the American Battle Monuments Commission’s Utah Beach Memorial. The ship’s leadership will also participate in a dinner reception hosted by Prefet Maritime, Vice Adm. Marc Veran, while the crew builds connections with their French counterparts and the local community during morale, education, and recreation tours and activities.

“It is an honor to represent the 371 Sailors serving aboard USS Normandy, as we visit the ship’s namesake port here in France,” said Capt. Gary Chase, commanding officer of USS Normandy. “Representing not only these Sailors, but the countless other French, American, and Allied heroes who gave their lives on these hallowed grounds is a moment in time that will not soon be forgotten.”

USS Normandy is named after the French region of Normandy,  the site of the D-Day landings on June 6, 1944 that shifted the tide of WWII in favor of the allies.  In the months that followed D-Day, American, French resistance, and Allied forces fought to drive Nazi occupiers from the region and establish a strong base for the final push to liberate France.  

 “The USS Normandy’s visit to Cherbourg is a poignant reminder of the long history of shared sacrifice of our two people in service of our shared values.  This visit will present invaluable opportunities for American service persons to meet with local communities and to reinforce the critical partnership between our forces,” said Denise Bauer, U.S. Ambassador to France. 

USS Normandy is deployed as part of the Gerald R. Ford Carrier Strike Group to enhance integration for future operations and demonstrate the U.S. Navy’s commitment to a peaceful, stable and conflict-free Atlantic region. Earlier this month, GRFCSG trained with France and other NATO Allies to demonstrate Ford-class aircraft carrier capabilities during exercise Silent Wolverine.

GRFCSG consists of Carrier Strike Group (CSG) 12, Carrier Air Wing (CVW) 8, Destroyer Squadron (DESRON) 2, USS Normandy (CG 60), USS McFaul (DDG 74), and USS Thomas Hudner (DDG 116).

Security News: Construction Company Owner Pleads Guilty to Bid Rigging and Bribery

Third Guilty Plea in Ongoing Investigation at the California Department of Transportation

A construction company owner became the third person to plead guilty for his role in a bid-rigging and bribery scheme involving California Department of Transportation (Caltrans) improvement and repair contracts.

According to a plea agreement filed today in the U.S. District Court for the Eastern District of California in Sacramento, Bill R. Miller engaged in a conspiracy, from April 2015 through at least December 2019, to thwart the competitive bidding process for Caltrans contracts on numerous occasions in order to ensure that companies controlled by co-conspirators or himself submitted the winning bid and would be awarded the contract. As part of the conspiracy, Miller recruited others to submit sham bids on Caltrans contracts, including co-conspirator William D. Opp, a former business partner who pleaded guilty in the case on Oct. 3, 2022. 

In addition to pleading guilty to bid rigging, Miller also pleaded guilty for paying bribes to Choon Foo “Keith” Yong, the former Caltrans contract manager who managed the contracts involved on behalf of Caltrans, a California state agency that receives significant federal funding. On April 11, 2022, Yong pleaded guilty to his role in the bid-rigging and bribery scheme. According to Yong’s plea agreement, Yong received the bribes in the form of cash payments, wine, furniture and remodeling services on his home. The total value of the payments and benefits Yong received exceeded $800,000.

“This construction company owner is the third person to plead guilty and the highest-level contractor to face justice in the Antitrust Division’s investigation into bribery and bid rigging at Caltrans,” said Assistant Attorney General Jonathan Kanter of the Justice Department’s Antitrust Division. “Transportation infrastructure is critical to our nation, so punishing bid-rigging and bribery schemes that target public works remains a top priority for the division and its Procurement Collusion Strike Force partners.”

“California has many government projects that obligate taxpayer money, making it important to root out corruption and protect the integrity of the contracting process,” said U.S. Attorney Phillip A. Talbert for the Eastern District of California. “My office is committed to investigating and prosecuting those who attempt to bribe public officials or who engage in other acts of public corruption that undermine the public’s confidence in the integrity of the government.”

Miller is scheduled to be sentenced on Feb. 6, 2023, by U.S. District Judge Kimberly J. Mueller. For the bid-rigging conspiracy, Miller faces a maximum statutory penalty of 10 years of incarceration and a fine of up to $1 million or twice the gross pecuniary loss resulting from the offense. For bribery concerning programs receiving federal funds, Miller faces a maximum statutory penalty of 10 years of incarceration and a fine of up to $250,000 or twice the gross pecuniary loss resulting from the offense. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and U.S. Sentencing Guidelines. In addition to his guilty plea, Miller has agreed to pay restitution. 

Today’s guilty plea is the result of a joint investigation being conducted by the Antitrust Division’s San Francisco office, the U.S. Attorney’s Office for the Eastern District of California and the FBI’s Sacramento Division as part of the Justice Department’s Procurement Collusion Strike Force (PCSF). 

In November 2019, the Department of Justice created the Procurement Collusion Strike Force (PCSF), a joint law enforcement effort to combat antitrust crimes and related fraudulent schemes that impact government procurement, grant and program funding at all levels of government – federal, state and local. In fall 2020, the Strike Force expanded its footprint with the launch of PCSF: global, designed to deter, detect, investigate and prosecute collusive schemes that target government spending outside of the United States. United Against Hate is an initiative launched by the Department of Justice focused on improving efforts to combat hate crimes and hate incidents through relationship building at the local level.  Through this endeavor, the Office seeks to create and strengthen trust and partnerships among law enforcement, community leaders, and residents.

“In my view, this initiative is particularly timely for Idaho, as we have experienced a series of troubling hate incidents throughout the state in the past several years,” said U.S. Attorney Hurwit. “As Attorney General Garland has said, this is a moment for an all-hands-on-deck approach to combatting unlawful hate.”

The November 17 event will include presentations from prosecutors about hate crimes laws and reporting mechanisms and speakers who will share their courageous experiences responding to hate.
