Federal Court Orders Forfeiture of $826K in Funds Used in Attempt to Export Dual-Use High Precision Jig Grinder to Russia

An investigation into the attempted smuggling of a dual-use export-controlled item to Russia in violation of United States export laws and regulations has resulted in the forfeiture of approximately $826,000.

As alleged in court documents and statements made in court, beginning in 2018, operators of a Latvia-based corporation conspired with the operator of By Trade OU, an Estonia-based company, as well as individuals in Russia and a Russia-based company, to violate U.S. export laws and regulations and smuggle a jig grinder that was manufactured in Connecticut to Russia. A jig grinder is a high-precision grinding machine system that does not require a license to export to European Union countries but does require a license for export and reexport to Russia because of its potential application in nuclear proliferation and defense programs. At no time did the defendants apply for, receive or possess a license of authorization from the U.S. Department of Commerce to export or reexport the jig grinder to Russia, as required by the Export Control Reform Act of 2018 and the Export Administration Regulations (EAR), which restrict the export of items that could make a significant contribution to the military potential of other nations or that could be detrimental to U.S. foreign policy and national security.

U.S. authorities, working with Latvian authorities, intercepted the jig grinder in Riga, Latvia, before it was to be shipped to Russia.

Several individuals and companies involved in this alleged scheme have been charged by indictment in the District of Connecticut with conspiracy, violation of the Export Control Reform Act, smuggling goods from the United States and international money laundering conspiracy offenses.

On Dec. 1, 2022, By Trade OU pleaded guilty to one count of conspiracy to violate the Export Control Reform Act, and one count of international money laundering conspiracy. In pleading guilty, By Trade OU admitted that it received funds from a Russian company, identified in the indictment as “Company B,” to purchase a jig grinder on its behalf from a Latvian company that had arranged to purchase the jig grinder from the Connecticut manufacturer.

On March 29, in a related civil forfeiture action, U.S. District Judge Victor A. Bolden ordered the forfeiture of $484,696 that had been delivered to the Connecticut manufacturer as part of the attempted purchase of the jig grinder. On April 4, 2023, in association with the sentencing of By Trade OU, Judge Bolden ordered the forfeiture of an additional €312,192.44 (approximately $342,000) seized from By Trade OU.

U.S. Attorney Vanessa Roberts Avery for the District of Connecticut; Director Andrew Adams of Task Force KleptoCapture; Acting Special Agent in Charge Michael J. Krol of Homeland Security Investigations (HSI), Boston; Special Agent in Charge Rashel D. Assouri of the U.S. Department of Commerce’s Office of Export Enforcement, Boston; and Special Agent in Charge Robert Fuller of the FBI New Haven Field Office made the announcement.

This investigation is being conducted by HSI Field Offices in New Haven, Connecticut; Portland Oregon; and the Hague, Netherlands; the U.S. Department of Commerce’s Office of Export Enforcement in Boston; and the FBI. The Prosecutor-General’s Office of the Republic of Latvia, the Prosecutor General’s Office of the Republic of Estonia, Latvian Tax and Customs Police, Estonian Tax and Customs Board and the Latvian State Police are assisting the investigation.

Assistant U.S. Attorneys Rahul Kale, Konstantin Lantsman and David Nelson for the District of Connecticut and Trial Attorney Matthew Anzaldi of the National Security Division’s Counterintelligence and Export Control Section are prosecuting the case. The Justice Department’s Office of International Affairs provided valuable assistance.

The investigation was coordinated through the Justice Department’s Task Force KleptoCapture, an interagency law enforcement task force dedicated to enforcing the sweeping sanctions, export controls and economic countermeasures that the United States, along with its foreign allies and partners, has imposed in response to Russia’s unprovoked military invasion of Ukraine. Announced by the Attorney General on March 2, 2022, and under the leadership of the Office of the Deputy Attorney General, the task force will continue to leverage all of the department’s tools and authorities to combat efforts to evade or undermine the collective actions taken by the U.S. government in response to Russian military aggression.

This case is being prosecuted through the Organized Crime Drug Enforcement Task Forces (OCDETF) Program. OCDETF identifies, disrupts and dismantles drug traffickers, money launderers, gangs and transnational criminal organizations through a prosecutor-led and intelligence-driven approach that leverages the strengths of federal, state and local law enforcement agencies. An indictment is merely an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

Three-story South State Street building to be demolished

Chicago’s 202-220 S. State Street federal facilities with a red box around the 208-12 three-story building, the one slated for demolition

CHICAGO – The U.S. General Services Administration will demolish a three-story building (208-212 S. State Street) over four to six weeks, with an anticipated start date of April 14, due to safety concerns. GSA will have safety barriers on the street during the demolition.

A recent conditions assessment found the non-historic building, which has been unoccupied for several years, is not structurally sound and presents risks, including potential facade collapse that would endanger pedestrians and street traffic.

This building is flanked by other GSA properties at 202 (Century Building), 214, and 220 (Consumers Building) S. State Street. GSA is continuing its discussions with stakeholders on the future of these three buildings, which will not be affected by this demolition.

GSA Administrator speaks, hosts tribal consultation at RES

LAS VEGAS – Yesterday, Administrator Robin Carnahan of the U.S. General Services Administration delivered remarks and hosted the agency’s formal Tribal consultation at the Reservation Economic Summit (RES) where she emphasized how GSA is deepening nation-to-nation relationships with Tribes and Tribal organizations. Hosted by the National Center for American Indian Enterprise Development (NCAIED), RES is an annual national event attended by thousands of Tribal government officials and business leaders throughout Indian Country.

Administrator Carnahan highlighted the Biden-Harris Administration’s pledge to honor the commitments between the United States and Tribal Nations. She also expressed how GSA is taking concrete actions to enhance relationships and engage in meaningful and robust consultations with Tribal officials to support Native American self-determination.

“President Biden and leaders across this Administration have made it a priority to strengthen the ties and trust between Tribal Nations and the United States. We can only succeed in delivering effective, efficient government if we work together,” said Administrator Robin Carnahan. “That’s our commitment, and my hope is that our conversations, and our daily work at GSA, demonstrate how we uphold our responsibilities, especially as we implement historic investments in America through the Bipartisan Infrastructure Law and Inflation Reduction Act.”

Administrator Carnahan noted a recent consultation with the Grand Portage Lake Superior Chippewa as an example of how infrastructure projects can foster a cooperative relationship built on trust and consensus building. This BIL Land Port of Entry project is taking place on trust lands along the border with Canada.

Carnahan also highlighted how GSA has ramped up efforts to strengthen support of Tribal communities by making its offerings more accessible to Tribal Governments and supporting Native American businesses in the federal marketplace. For example, later this year, GSA plans to update tools to increase visibility of Native American owned businesses for GSA customers, partners, and acquisitions professionals.

At the afternoon consultation, over 100 participants joined Carnahan and GSA leaders for discussions on major topics of interest to Indian Country, including small business contracting, partnering with GSA to procure electric vehicles, and a pilot program to support federal buying of carbon pollution-free electricity from Tribal organizations. Participants from GSA included: Julie Ramey, GSA Tribal Liaison in the Office of the Administrator; Erville Koehler, Assistant Commissioner of the Office of General Supplies and Services in the Federal Acquisition Service; Crystal Philcox, Assistant Commissioner of Travel, Transportation, and Logistics in the Federal Acquisition Service; and Tracy Marcinowski, Assistant Commissioner for Acquisitions in the Public Buildings Service.

GSA publishes guidance for federal agencies to buy secure 5G

Provides shared reference for technical and contracting specialists to align their efforts with National Strategy to Secure 5G

WASHINGTON — This week, the U.S. General Services Administration (GSA) published plain-language guidance to help government agencies buy fifth generation (5G) wireless technology, an innovation that supports higher data-transfer rates, more energy savings, higher capacity, better device connectivity, and other benefits.

GSA’s Acquisition Guidance for Procuring 5G Technology supports an ongoing, multi-agency effort to document and share best practices for optimal 5G deployments.

Mobile technology is a global economic driver, and each generation brings faster speeds and added support for new services. The first generation (1G) enabled cell phones, the second (2G) introduced texting, the third (3G) began the era of the smartphone, and 4G long-term-evolution (LTE) delivered streaming video and fast mobile internet access.

“5G networks have the potential to be faster, more reliable, and serve many more devices — and could provide infrastructure to help with everything from smart buildings to telemedicine,” said Federal Acquisition Service Commissioner Sonny Hashmi. “We’re pleased to be issuing this guidance to ensure that government can make the most of secure 5G in its efforts to deliver for the American people.”

Congress passed the Secure 5G and Beyond Act of 2020 which required the federal government to develop a four-pronged strategy to ensure the security of next generation mobile telecommunications systems and infrastructure. The resulting National Strategy to Secure 5G details how the U.S. will lead global development, deployment, and management of secure and reliable 5G infrastructure.

Part of that strategy takes aim at reducing supply chain risks to U.S. economic and national security during the development and deployment of 5G infrastructure worldwide. To support this effort, GSA was charged with “establishing acquisition processes to facilitate 5G infrastructure for classified information requirements.”

“We’ve worked hard to ensure that this guidance collects best practices from across the government,” said Laura Stanton, GSA’s Assistant Commissioner for the Office of Information Technology Category. “We have confidence that it will go a long way toward helping federal IT managers, contracting offices, and their industry partners work together to build secure 5G systems.”

The guidance released today focuses on achieving that goal by orienting agencies and their vendors to Best-In-Class acquisition vehicles that feature secure 5G services within their scope.

GSA Awards Bipartisan Infrastructure Law Contract for Work at Vermont Land Ports of Entry

BOSTON – The U.S. General Services Administration (GSA), as part of the Bipartisan Infrastructure Law Land Port of Entry program, has awarded a contract to provide the National Environmental Policy Act services at four land ports in Vermont.

GSA awarded the $922,938.00 contract to WSP USA Solutions Inc. WSP will evaluate the environmental and related social and economic impacts of each of the four port projects on their surrounding communities.

The firm will support the National Environmental Policy Act (NEPA) process, which allows the public to provide input and comments through public information meetings and public hearings. NEPA provides steps and procedures to evaluate the potential social, economic and environmental impacts of project alternatives while providing an opportunity for local, state, tribal and Federal agencies to provide input on these four GSA projects.

GSA plans to design and construct facilities that incorporate sustainability features that will reduce greenhouse gas emissions, mitigate environmental impact, and simultaneously increase the mission readiness of the Federal Government by increasing resilience to climate change.

GSA’s goal is to provide sustainable, climate resilient facilities which are functional, technologically efficient, and provide a welcoming gateway into the United States.

The projects covered by this contract are located in Alburg Springs, Beebe Plain, Norton and Richford. Overall, the Bipartisan Infrastructure Law allows GSA to invest more than $115 million in these four Vermont land ports.

The projects will improve public and officer safety, as well as expedite crossing times for the traveling public and businesses that rely on binational commerce. Beyond creating state of the art facilities that support the mission of the U.S. Department of Homeland Security’s Customs and Border Protection, these investments will also foster local economic growth and job creation.

“The ports of entry along the Vermont border are intrinsic to the fabric of life and community along the New England border with Canada,” New England (Region 1) Public Buildings Service Commissioner and Acting Regional Administrator Glenn C. Rotondo said. “Our National Environmental Policy Act efforts will be an integral part of our community engagement efforts for these projects. We are excited for the opportunity to begin the process to improve these facilities, and the economic prospects these projects will bring to the region.”
