A man charged federally with being a felon in possession of ammunition is being sought for allegedly absconding from pre-trial release in Albuquerque.

Adrian Nieto, Jr., 19, of Albuquerque, is accused of leaving an Albuquerque halfway house without permission on December 24, 2020, a day after he was placed on pre-trial conditions of release.

The FBI had arrested Nieto on December 17, 2020.

A federal warrant has been issued for Nieto’s arrest.

Anyone with information on the whereabouts of Nieto is asked to contact the FBI at (505) 889-1300 or online at tips.fbi.gov.

The Albuquerque Police Department is assisting with the investigation.

On Monday, January 18, 2021, Leo Christopher Kelly was arrested on a federal warrant by special agents from the FBI Omaha Field Office’s Cedar Rapids Resident Agency. The federal charges include Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority, and Violent Entry with Intent to Disrupt the Orderly Conduct of Official Business and Disorderly Conduct on Capitol Grounds. The charges stem from the events at the Capitol Building on January 6, 2021.

Kelly remains in federal custody. He will have his initial appearance in federal court on Tuesday, January 19, 2021. After Kelly’s appearance you will find any additional information at this link—Investigations Regarding Violence at the Capitol (justice.gov).

To ensure the safety of our communities, the FBI Omaha Field Office has established a command post to gather intelligence and coordinate with our local and state partners on potential threats. At this point in time, the FBI has not received any specific and substantial threat to the state Capitols or other government buildings in our area. However, we are working together with our law enforcement partners to continuously share information based on tips submitted by the public.

FBI Omaha is focused on identifying, investigating, and disrupting individuals who continue to incite violence and engage in criminal activity here locally. Special Agent in Charge Eugene Kowel says, “Between now and the presidential inauguration on January 20, we will maintain a heightened posture to monitor for any emerging threats to our region.”

The FBI is reviewing an agent-involved shooting which occurred today when special agents executed a federal search warrant at a residence in Florissant. No one was injured, and a male subject was arrested.

The FBI takes all shooting incidents involving our agents seriously. In accordance with FBI policy, the shooting incident is under investigation by the FBI’s Inspection Division. The review process is thorough, objective, and conducted as expeditiously as possible under the circumstances. As this remains an on-going matter, the FBI has no further comment.

BATON ROUGE, LA – Throughout the weekend, public safety officials from numerous federal, state, and local agencies worked to coordinate security protocols and ensure safety for protesters, Capitol grounds, and the surrounding community. The peaceful assemblies and activities throughout the weekend were a testament to the intended purpose of our First Amendment rights, including the right to peacefully protest.

Leading up to Inauguration Day on Wednesday, January 20, 2021, a multi-agency collaborative team will remain in a heightened posture to monitor for any emerging threats to our state. No specific and substantiated threat to life or property has been identified at this time to include the State Capitol or other government buildings.

All agencies remain steadfast in our mission to protect our citizens and deter criminal activity which prevents others from peacefully expressing their First Amendment rights.
